Broken Bar Glass Led to My Injury

In February, I attended an event called Awesome 80's Prom located on 901 W. Weed Street with my boyfriend and another couple. While there, I slipped and fell on the dance floor.

It was very dark and loud on the dance floor. Unknown by me, a drink had been dropped by an attendee which had made where i was dancing wet and slippery. Large shards of glass also littered the dance floor from the dropped drinking glass. I happened to fall on one of these pieces of glass when i slipped, gashing open my left knee.

After my fall, i stood up and immediately felt something drip on my foot. Looking down, i saw that my leg was covered in blood. I turned to my boyfriend and said, "I think i'm bleeding." He took one look at the amount of blood and told me, "We need to go." We left the prom immediately and via cab returned to my home which was located nearby. The only time i actually looked at the wound was in the cab and it make me sick to my stomach.

While at my home, my boyfriend attempted to clean the wound and stop the bleeding. Once my tights were off and he could see it in the light, he knew that i would have to have stitches. We then went to the Lincoln Park Hospital Emergency Room where i was cleaned and stitched. I received eight stitches.

We have contacted Awesome 80's Prom several times and spoken to the manager. He insists that they will not pay for my medical bills that total at $1700. I am sure that they have an insurance policy for which these costs are covered, however, they refuse to cooperate.

I am a graduate student earning my PhD in Clinical Psychology and i simply cannot afford these extraordinary medical costs. But even putting money aside, I believe Awesome 80's Prom to be responsible for the safety of their patrons and accidents that occur on site such as this one.

Attorney, Cliff Horwitz:

I would recommend you go to small claims court.  The medical bills and injury are not sufficient to warrant the high expense of gong through the court system where you are represented by an attorney.  However, you can go to the Daley Center in Chicago and file it in the Small Claims Court for approximately 1/8th the cost.   Small Claims Court is like the People's Court on TV and is designed for cases to be prosecuted without a lawyer.
 
The defendant may well have Medical Payment Coverage.  If they do, that would cover your medical bills even if defendant was not negligent.  Usually companies have a medical payment coverage provision in their policy covering about 5 to 10,000 in bills.
 
If there is no coverage for MPC (medical payment coverage) you will have difficulty here because you will have to prove defendant was negligent.  They will claim they were not careless or negligent because they didn't know and should not have known that a customer would break glass on the floor and they should not have reasonably realized there was glass on the floor until it was too late.
 
These can be very tough cases.
