Local 272 Carpenter Recovers $1 Million Settlement after Balloon Wall Fall
On a residential jobsite in Bollingbrook, Illinois, a carpenter from Local 272 fell sixteen to eighteen feet when a crane swung a second balloon wall into the one he was positioned on during windy conditions and without warning. As a result of the fall, the carpenter suffered a severe back injury.
The carpenter’s attorneys, Cliff Horwitz and Jay Luchsinger of the law firm of Horwitz, Horwitz and Associates, demonstrated that the defendant failed to follow standard practices in hoisting and placing balloon walls.
Attorney Jay Luchsinger noted: “Defendant had a clear view of our client up on the wall in order to tie it in. The wall should not have been swung in such windy conditions, particularly with no tag lines attached.”
The million-dollar settlement followed lengthy and heavily disputed litigation.
