Jones Act Case Results in $2.2 M Jury Verdict
Our trial team won a $2.2 million jury verdict for a 65 Riverboat janitor who injured his back, resulting in a two-level fusion, while lifting trash. The case was filed under the Jones Act.
The injury was superimposed upon a previous injury the worker had suffered several years earlier, but from which he had fully recovered.
We demonstrated that Harrah's employees threw bottles in the trash contrary to company policy. The jury found the Plaintiff to be 25% at fault and reduced the verdict to $1.6 million. The company is currently appealing the verdict.
Prior to trial, the company had offered to settle for just $30,000. Even after the verdict, their offer increased to only $300,000. Hence, the worker will have to wait until the Appellate Court decides if the jury's verdict was excessive, or if the lower Court made a legal ruling that was improper.
