Laborer out of local 288 recovers $3.6 million when a prefabricated concrete floor that he was standing on collapsed from underneath him just after he erected it.
He fell 20 feet suffering a herniated disc and torn rotator cuff, requiring surgery to his shoulder and back, leaving him with permanent lifting restrictions and forcing him out of his trade.
The defendant, McHugh- Riteway Joint venture argued that it was solely the employer's fault because the employer manufactured the concrete and it was flawed. However, we discovered evidence of cracks in the concrete that the general contractor ignored and allowed to be incorporated into the building, which would have been a permanent danger to future students at 31st and Kostner, Little Village.
