Apprentice Ironworker recovers $2.3 million
Apprentice Ironworker recovers $2.3 million for serious injuries to wrist due to fall through hole in decking.
The local one ironworker was guiding bundles of steel and walking back backwards when he walked into the hole. The defendant, McCormick West and Cordeck Sales, Inc. failed to cover the opening in the decking violating OSHA and ANSI standards leading to this injury.
Defendant argued that the 23-year-old ironworker was merely an apprentice for four months and had a college education; that he would not have continued being an ironworker. They further conducted video surveillance on him and saw him perform four hours of shoveling. Defendant further argued that the ironworker failed to watch where he was walking.
