The employer, Interstate Scaffolding, Inc., fired the injured worker, Jeff Urban, and then refused to pay benefits, claiming that Mr. Urban had been fired “for cause.”

The Illinois Supreme Court reversed the appellate court’s decision and reinstated Mr. Urban’s award of TTD benefits
The court stated, “an employer’s obligation to pay TTD [Workers’ Compensation] benefits to an injured employee does not cease because the employee [was] discharged — whether or not the discharge was for ‘cause.’”
Horwitz, Horwitz & Associates fought this battle at Arbitration, before the Illinois Workers’ Compensation Commission, in the Circuit Court, the Appellate Court, and all the way up to the Illinois Supreme Court. Thanks to this decisive victory, injured workers who are fired while on “light duty” will be entitled to receive Workers’ Compensation benefits, even if the employer claims they were fired “for cause. This will have a major impact in the future on employer’s using the tactic of firing people “for cause” in order to escape paying workers compensation case.
