Jury Verdict For Laborer Whose Foot Was Struck By A Defective Forklift ($2.85 Million)

The lead trial team at Horwitz, Horwitz & Associates won a $2.85 million jury verdict for a laborer who suffered a degloving injury to the heel of his foot.

The Case

The laborer was struck by a forklift truck operated by a co-worker. Horwitz, Horwitz & Associates sued the company that performed preventative maintenance on the forklift claiming that they improperly maintained the vehicle, which caused the brakes to fail.

In-Depth Look

Attorneys for the Defendant presented to the jury secret surveillance video footage that showed the Plaintiff running. We presented the same video to the jury in slow motion several times, pointing out that the Plaintiff was truly jogging on his toe because he could not bear weight on his heel.

At present, the insurance company for the Defendant is now suing the defense attorney for malpractice claiming that the verdict was too large and the defense attorney is at fault.
