        • The Case

          A nursing home resident developed numerous bed sores on his lower extremities and was ultimately sent to the hospital where he was diagnosed with septic shock.  Due to the toxic nature of sepsis, it was recommended that the man undergo an emergency surgery during which he had to have his right leg amputated.  Prior to his admission to the nursing home, our client had suffered multiple strokes and was entirely depended on the staff for his activities of daily living.

          The client’s wife hoped that her husband could return home after the surgery.  He was receiving rehabilitative care at the nursing home and his care plan indicated he was at high risk for developing pressure sores.  During his rehab care for his right leg amputation, he developed gangrene in his left foot.  This infection was so severe that he had to have another surgery during which his left foot was amputated.

          The nursing home denied it was responsible for our client’s leg amputation. Family members testified the facility was severely understaffed and had noticed during visits to the nursing home that the staff failed to turn him for extended periods of time.  Defendants were unable to provide documentation that he was turned every two hours.

          Family members also testified that upon visiting him, they would find his clothing and undergarments had not been changed and he had not been taken to the bathroom for several hours.
