Staff Drop Resident from Hoyer Lift and Do Not Report it for Two Weeks

        Recovered Favorable Settlement

Injury attorneys at Horwitz, Horwitz & Associates negotiated a favorable settlement incurred in favor of their client.

        • The Case

A female resident was dropped from a Hoyer lift while she was being transferred from her bed to a wheelchair. The staff did not perform an X-Ray for two weeks. After this incident, the resident went to the hospital for knee pain and the doctors identified a broken knee cap and femur. She went to the hospital a second time and doctors found two morphine patches on her body when her chart indicated she should only have on one a time. Doctors also identified numerous bed sores that were the result of a lack of re-positioning every two hours. The bed sores became infected and the resident died shortly after her second visit to the hospital from sepsis.

        • In Depth Look

Horwitz, Horwitz & Associates’ nursing home abuse and neglect attorneys argued that the facility was negligent and breached its duty of care to the resident by failing to address her bone fractures after she was dropped from the Hoyer lift. The injury attorneys were able to show that the facility was severely understaffed.

The defendant claimed that the allegations should be dismissed because the entities were improperly sued. The defendants attempted to escape liability through a procedural rule rather than addressing the substantive legal claim of negligence.
