The defendant argued that the rebar only weighed 20 lbs. and the stone mason continued working after the accident for a lengthy period of time; so therefore, the back injury could not be due to the incidence in question.
Horwitz argued the men didn’t have the leverage to carry the rebar the way it was being done and put men at lower levels at risk of the rebar falling on them. The case was settled on a highly disputed basis.
