Clifford W. Horwitz, a principal partner and lead trial attorney at Horwitz Horwitz & Associates answers a listener’s question on Free Legal Advice Friday’s:
What determines the value of my personal injury case?
You have to use an attorney unless it’s a small claims case.
Unless it’s a case under $10,000.00 where you can do it yourself, you want an attorney.
Again, you can analogize it to a doctor. You don’t treat yourself on a significant injury, you have to have a doctor do it. To think you can go into the courthouse and understand the rules of evidence and the rules of procedure, it’s just not going to happen. So, you have to have an attorney take you through it.
From Chicago injury lawyer and partner at Horwitz, Horwitz & Associates, Jay Luchsinger:
Well, there are many factors. Every case is singular and individual. Every case is different – the law doesn’t come off the shelf. The law is many factors that affect your case.
The facts surrounding your injury – how you got hurt.
Whether or not there is an entity – a company – that had a legal duty to make sure that you had a safe place to work or whether or not the product was safe.
The degree of your injury, the severity, the nature, and extent of your injury.
All these are rather intangible elements that contribute to what is the type of lawful compensation that a jury can award.
From Chicago trucking accident attorney and partner at Horwitz, Horwitz & Associates, Michael Wierzbicki:
Ultimately compensation for injuries is determined by what the jury is instructed and largely what they’re instructed is to consider the damages which are typically: pain and suffering, medical bills, loss of a normal life or disability, wage loss, and things of that nature.
Each case again is different depending on the injuries that each person sustained.
So, you should call a lawyer and discuss with them what your case may be worth and how a jury would determine your case.
