I was Rear-Ended and Now Have Severe Pain

Question:

I was sitting at a stop light in rush hour traffic. The driver of the car behind me nodded off and ran into the back end of my car. Hit me hard enough to push me into the van in front of me while I had my foot on the brake.
Now I have severe lower back, hip and leg pain.

Answer:

Attorney Cliff Horwitz:

Low back pain and leg pain is usually indicative of a possible herniated disc or spinal problem. It is important that you receive treatment from top-level orthopedic surgeons to make sure that you are properly taken care of and diagnosed.
As to the driver of the other car, it would seem clear that he was negligent and that you are entitled to compensation. However, the only thing to be concerned of here is when a defendant takes the position that he had some type of seizure or attack that he could not predict and would therefore not be negligent.
You want to end that argument by doing early investigation. We can help you if you wish. Good luck to you.

Cyndi responds:

Thank you for responding. During the police report the officer had asked him if he had any medical conditions that would have caused this to happen and he said no, he was tired and nodded off. Each day the pain seems to get worse. I have not slept in 3 nights because of the pain. You mentioned I needed to see an orthopedic surgeon. Is there one that you recommend or should I find one on my own?

Attorney Cliff Horwitz:

I believe you must see an orthopedic physician in light of your symptoms. These problems can progress and become life long if not taken care of properly.
As to our fee, it is the standard fee in our field. We charge one-third of whatever is recovered. There is no charge unless and until we win. Hence, we would fight for you until a recovery is had. You are the boss. Once we recover through a jury verdict or settlement, only then would we receive the 1/3 fee. The 1/3 fee is actually taken out of the money the Defendant insurance company pays in the end. If we didn’t prevail for you (which is unlikely to say the least) then all of our work, no matter how much, would be for free.
Our goal to get you properly treated so that you can live a normal life and to obtain a maximum recovery for you.
We can help you find a good orthopedic physician in your area. However, the best physicians are in the City of Chicago.
