Clifford Horwitz and Jay Luchsinger alleged that the defendant, general contractor R.L. Sohol, Inc., failed to provide adequate fall protection while the IronWorker was on a beam. The defendant argued that the plaintiff was a foreman and therefore ran the job, not R.L. Sohol. Horwitz and Luchsinger produced evidence that there was no tie off available to the IronWorkers. The jury agreed with Horwitz and Luchsinger, and awarded $2.7 million to the injured IronWorker.
