        150 150 Clifford Horwitz

        What Juries Do Not Know

99% of trials in personal injury cases are about insurance.  What juries do not know, is that the true battle is between the injured individual and the insurance carrier who represents an individual or corporation who is being sued.  The jury is led to believe that the Defendant is an individual or a corporation, but the case is really about his insurance policy and the insurance company… and the droves of attorneys for the insurance company who will fight not to compensate fairly and pay what’s due.

Birth Injury v. Birth Trauma v. Birth Defect

The Center for Disease Control and Prevention report, Expanded Data from the New Birth Certificate, lists 1,188 significant birth injuries among 2,073,368 births. A significant birth injury was defined as skeletal fracture(s), peripheral nerve injury, and/or soft tissue/solid organ hemorrhage which requires intervention.

Other studies, such as the Potentially Avoidable Injuries to Mothers and Newborns During Childbirth, 2006 by H-CUP list problems during the birthing process (labor or delivery) to newborns as 1 in every 1000. These problems could be fractures, infections, or head injuries among others.

        Common Construction Site Accidents

        150 150 Clifford Horwitz

Construction sites are rife with potentially fatal hazards. This is one reason why OSHA and other governing bodies are so strict when it comes to enforcing jobsite safety regulations – reducing construction site accidents is of great importance.

Unfortunately, many construction zone managers and third-party companies who work onsite overlook workplace safety laws. This often leads to serious and potentially deadly injuries to workers and innocent bystanders.

The construction industry is responsible for 20 percent of all on-the-job fatalities in the United States. In other cases, injuries lead to permanent disabilities and prevent victims from returning to work.

3 Types of Damages that Slip and Fall Victims can Claim in Illinois

        150 150 Clifford Horwitz

Some of the most devastating personal injury cases stem from slip and fall accidents. Falls can be particularly harmful for senior citizens, according to the Centers for Disease Control and Prevention.

A serious fall can lead to long-term medical complications, including back and joint injuries. Expensive medical bills can threaten victims’ financial security, and lengthy recovery periods can prevent them from returning to work.

Fortunately, Illinois laws protect the rights of people who suffer injuries due to the negligence of others. As a slip and fall victim, you may be able to file a lawsuit against the at-fault party and recover damages to pay for accident-related expenses. Taking legal action can also prevent others from falling victim to the same negligent behavior.

Three types of damages that slip and fall victims can claim in Illinois:

I Fell at Work and Didn’t Get Proper Medical Care

        150 150 Clifford Horwitz

        Question:

I was walking across an area of muddy water. One hour before some guys had dug a hole 1 1/2ft deep to put in a sub pump, then changed their minds and put it at other end.

The hole was never marked and not visable under muddy water. When I stepped forward it threw me forward and backwards in accelerated/decelerated whip/backlash force. I felt tingling and numbness in my face right away. I later found out I had tore muscles in my back, herniated discs, tmj and many symptoms of TBI from the whiplash that may have caused shearing of the nerves.

Recent test results show vertical oculomotor abnormalties, Spontaneous and positional nystagmus as well as gaze-rebound nystagmus. I have had two abnormal EEG’s. Although MRI’s and MRA’s didn’t show anything. I have seizures from the injuries. Otherwise sometimes I have balance problems where I stagger, loose my coordination and vision sometimes.

Now I have difficulties with memory, learning as I tried to go back to retrain but constant seizures and memory problems made it hard. I have had numbness and tingling in my face and head area. My brain goes numb sometimes in the front top and sometimes it has pain there like when you eat ice cream too fast.

I had a letter from the Governor stating no one was to stop my medical and was cut off four times so I didn’t get proper medical treatment.  I was told by a doctor that when a nerve is damaged that it starts to kill the nerves around them from toxic chemicals released in the brain if not getting proper medical treatment.

Serious brain injuries are among the most common and debilitating effects of car accidents, and anyone who is in a serious crash is at risk of sustaining one.
