        Play Yard may be Choking Hazard to Small Children

        Question:

        Our son, Connor, likely ingested several long pieces of plastic from a play yard several months ago. He was given treatment at Children’s Memorial, and although the doctor found nothing in his airway/trachea, she averred the product represented a choking hazard.

        We have made a demand letter to the retailer, and several followup letters, to no avail. I gave them until 9/15 to respond – all I was demanding was out of pocket.

        I realize this may not be of much interest to you – our actual damages are less than $1000 – but I contact you for two reasons: are you interested in possible class action? And, in the event we go pro-se with this, do you have the name of the Illinois Registered Agent?

        Can “fear of eating out” be part of a Lawsuit After Injury at a Restaurant?

        Question:

        A friend of mine was eating at a restaurant and after she took a bite of her burger she got a sliver of broken glass stuck in the roof of her mouth. It broke off and she had to have it dug out. She wants to sue for medical bills and a small personal claim for not feeling safe to eat out anymore. Can she do that? She’s asking for $10,000 total. The incident happened a week ago, and she said she filed a complaint.

        I can’t quit smoking cigarettes. Can I sue them for putting addicting drugs in the cigarettes? When I play softball I lose my breath a lot easier now. I am a physically fit man. I lift and get out and run but it seems I can’t go the distance like I did five years ago. I have been smoking since I was 16.

        I Believe Sodas Ruined My Life

        Question:

        For 34 of my 40 years of life, I believe that I have been addicted to drinking cola beverages. I have tried more times than I could remember to quit, but I would develop severe withdrawal symptoms that kept me reaching for more colas.

        I believe that years of drinking excessive colas have lead to the deterioration of my teeth (multiple root canals, cavities, beginnings of gum disease, as well as digestive difficulties that keep me on Imodium daily (irritable bowel syndrome).

        I am old enough and educated enough (I am both a practicing chiropractor, as well as a recent med. school graduate waiting to take the board exams) to realize that caffeine is addictive, but when I was 5-20 years old, this was not common knowledge, and I developed my addiction.

        I believe that the soda industry places caffeine in their beverages to addict consumers, which creates increased sales for their products. Unfortunately for consumers like myself, we were not informed of this at a time when we are most impressionable… in our youth and teenage years.

        I hope that I don’t sound like a conspiracy theorist, but I strongly believe that my addiction to cola has had significant, negative affects on my health. I am interested in suing the major soft drink manufacturers, because I crave colas constantly), and would like your input on this matter. Please contact me at your earliest convenience.

        During an Auto Accident, All Six Airbags Failed

        Question:

        My mother and sister where recently involved in an auto accident. It was a head-on collision when they where turning and they where hit on the right side front of the vehicle.

        The police report I believe states the other driver was traveling at 50mph. My mother was knocked unconscious and received several small injuries, my sister hurt her neck and other injuries as well.

        This vehicle is equipped with 6 airbags and not one of them deployed. Can you advise me what their legal rights might be in a case like this?

        My Brother was Killed While Working in a Coal Mine

        My brother was killed in a coal mine. The machine he was running proved to be faulty.

        The company that makes the machine and the company that was allowing the employees to use the machine both knew about this danger.

        My Husband was Injured 3 Years Ago… Is there a Way I can Get the OSHA Report?

        Question:

        My husband was injured 3 years ago. His foot was caught in a hydraulic cylinder and was cut off. The foot was reattached. The doctor said now that there is nothing more he can do. The accident happened three years ago. Now they have recommended amputating from the knee down. We have opted to save the foot. The foot has been fused at the ankle. He can walk but with lots of pain. I am ready to settle with workman comp. I also would like to sue the manufacturer of the machine. How do I get started? I want my husband to live a normal life and not have to struggle every day with Social Security and workman’s compensation. The injury happened at Building Products and they were fined by OSHA. Is there a way I can get the OSHA report. Would that help my case?
