Maintaining Safe Speeds – Truck Drivers and Motorists

        150 150 Clifford Horwitz

Truck accidents often end in devastating injuries that can cause long-term disabilities. According to the National Highway Traffic Safety Administration, speeding causes 26 percent of truck wrecks, but these crashes can result from distracted driving, inclement weather and a range of other factors. If you were injured in a collision with a semi-truck, then you should immediately contact an injury lawyer with experience in prosecuting trucking accidents.

Even the safest motorists practicing defensive driving cannot control the actions of other drivers. All too often, commercial truckers drive more hours than allowed by law, or they load their trailers to weights above the maximum capacity. In these circumstances, accident victims may be able to file a lawsuit for medical bills, lost wages and other damages.

        Common Construction Site Accidents

        150 150 Clifford Horwitz

Construction sites are rife with potentially fatal hazards. This is one reason why OSHA and other governing bodies are so strict when it comes to enforcing jobsite safety regulations – reducing construction site accidents is of great importance.

Unfortunately, many construction zone managers and third-party companies who work onsite overlook workplace safety laws. This often leads to serious and potentially deadly injuries to workers and innocent bystanders.

The construction industry is responsible for 20 percent of all on-the-job fatalities in the United States. In other cases, injuries lead to permanent disabilities and prevent victims from returning to work.

Tips for Responding to an Automobile Accident

        150 150 Clifford Horwitz

Auto accidents can happen suddenly – sometimes without even the slightest warning. People with good driving records may feel safe, but nobody can control the actions of negligent motorists. In addition to physical pain, victims often face legal hurdles when trying to recover compensation for health-care bills, lost wages and other damages.

Practicing safe driving etiquette is a good way to reduce your chances of getting into an accident. For example, it is best to limit driving during rush hour, weekend nights and holidays due to heavy traffic and the higher potential for drunk-driving collisions. If you are involved in an accident, then it is critical that you know how to respond in a way that protects your interests.

The Insurance Company is Denying What is on a Police Report

        150 150 Clifford Horwitz

        Question:

My son and daughter were in a car accident. They were driving straight down a road when a truck taking a left turned out in front of them and my son swerved to avoid hitting the truck head on.

The other driver was given a ticket for failure to yield to oncoming traffic and the police officer indicated by checking a box that the other driver was inattentive, and now the other driver’s insurance company is denying our claim.

When a failure to yield right of way ticket is given, isn’t this a strong indication that the person who failed to yield caused the accident?

I can’t believe that the other guy’s insurance adjuster agreed with me that if her insured hadn’t turned out in front of my son there wouldn’t of been an accident, so how can she deny our claim?

I am thinking about suing the man who hit my son.

Can a Youth Group Home be Held Liable for My Brother’s Death?

        150 150 Clifford Horwitz

        Question:

My 14-year-old brother was killed on 2-27-03 while being a resident at a Youth group home. It was a day when it was snowing and the neighbor of the group home had his truck trying to remove snow from his driveway and the Group home’s driveway.

My brother and several other boys were trying to help the man get his truck unstuck and my brother was on back of the truck and slipped off and was backed over entirely and was trapped under truck.

The people there were scared that if they removed the truck or lifted it up that it would hurt him more. They left him under the truck and he suffocated in the snow.

My question is would not only the man driving the truck be responsible but wouldn’t the group home be since they were responible for him while he was there? There should have been supervision outside where these kids were, etc.

I was Reinjured and Have Lost Everything

        150 150 Clifford Horwitz

        Question:

07/28/2000 – threw Bad Order Switch that threw me for a loop and had to have c5 and c6 fused and also found severe carpal tunnel in both hands.

Feb 2001 – Dr. Durward fused c5 to c6 using a plate and did carpal tunnel release on left hand.

May 2001 – did carpal tunnel release in right hand.

Nov 2001 – truck on the highway turned right in front of me in a 50 MPH zone. Wreck caused break of c5 and c6 fusion and had to do the c6 to c7 fusion done Feb. 2001.

Had deposition around this time last year with BNSF now they want another on the 18th of this month and my lawyer says he cannot represent me anymore (he said conflict of character). I just wanted answers to my questions. we are talking the rest of my life here. I cannot even get a job at McDonald’s.

09/30/2002 – Dr. Durward (Nuerosurgeon) found me permanently disabled. I have already applied for RR Disability a couple of months ago. My court date is 12/03/2002 in Des Moines, IA.

I cannot go on anymore – I had to close my $640,000.00 business because I could not do anything but the bookkeeping. My wife then left me in April 2001, divorced April 30, 2002. I could no longer supplement my income to help it in time of need. Without the $70,000.00 railroad job we had nothing. I need immediate attention for the next couple months.

If this lawyer does not show for the deposition do I have any recourse with him not attending? I was also told that he would go over my case file with whomever I choose. I do not want to take this individual off the case because he knows it so well. We have had arguments but I am the one who is permanently disabled – my family leaves me, I lose my business, I have made commitments for payments to be made in Dec. read more

Elements of a Motorcycle Accident and Injury Claim

        150 150 Clifford Horwitz

The Centers for Disease Control and Prevention reports that 4,502 motorcyclists died in 2010 alone. Motorcycles offer their riders almost no protection from reckless drivers. As a result, these tragic accidents often involve serious injuries and fatalities.

Many of these crashes happen as a result of another driver’s negligence. This may be the case if a driver causes an accident while using a cellphone, speeding, eating or not paying attention to the road and road signs.
