Liability for Injuries Caused by Button Cell Batteries

Companies that create consumer products have a legal obligation to ensure that they are reasonably safe. They have to take into consideration all of the ways their products could be used and even potentially misused. This is all the more important when a product is likely to be used by young children. Manufacturers should take several measures to protect children from the hazards posed by button cell batteries.

  • Manufacturers should require that button cell batteries can only be accessible with the use of tools.
  • Manufacturers should make sure that any of their products containing button cell batteries are sturdy and unlikely to break.
  • Manufacturers should provide warning labels on any products with button cell batteries.
  • Manufacturers should comply with all relevant safety standards, including Reese’s Law.
  • Manufacturers should ensure that any products containing button cell batteries are in child-resistant packaging.

If a company creates a product that has design defects or fails to abide by safety standards, this could form the basis of a product liability claim. A manufacturer could also be liable for a consumer’s injuries if their product contained marketing defects. Marketing defects may occur if a manufacturer fails to warn consumers about the non-obvious dangers associated with the use of their product.

Steps to Take After Accidents Involving Button Cell Batteries

A number of children are seriously injured every year after ingesting button cell batteries. According to the Consumer Product Safety Commission, “Over 70 children have died, and tens of thousands have found themselves in emergency rooms, after swallowing button batteries. ” Multiple steps should be taken after any child is harmed by ingesting a button cell battery.

  • The child should receive medical treatment as early as possible.
  • The product that contains the battery should be identified.
  • The product involved in the accident should be stored in a secure location where it is not likely to cause further harm.
  • The parents of the injured child should seek the guidance of an experienced product liability attorney.

Injuries associated with the battery ingestion can be absolutely devastating. Children can develop sepsis and major trauma. As indicated previously, a number of children have died. It is important that the family members of any child harmed by button cell batteries understand they do have legal rights.
