Liability For Buffalo Grove Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in pedestrian accidents. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” Young children and elderly pedestrians are particularly vulnerable. There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should be well rested before heading out onto the road.
  • Drivers should continuously scan the road ahead of them.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians in the roadway. Pursuant to 625 ILCS 5/11-1003.1, drivers should slow down and use their horn when necessary to alert pedestrians of their presence. Drivers must be especially cautious around pedestrians or any confused person in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Many steps should be taken after any pedestrian collision.

  • Surveillance footage of the collision should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • A thorough investigation should be conducted.

Many pickup trucks are used for commercial purposes in construction, logistics and landscaping. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. Generally speaking, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. It is extremely important that all evidence is properly preserved after an accident. Evidence is what will ultimately be used to determine liability for any crash.
