Liability In Crystal Lake Car Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to the Centers for Disease Control, “more than 32,000 people are killed and 2 million are injured each year from motor vehicle crashes. In 2013, the US crash death rate was more than twice the average of other high-income countries.” There are many different factors that could potentially contribute to a car accident.

  • Speeding
  • Drunk driving
  • Inclement weather
  • Driver distraction
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid collisions. A large portion of collisions are due to drivers that are speeding. Pursuant to Illinois Vehicle Code 625 ILCS 5, no person shall drive a motor vehicle at a speed greater than would be safe or reasonable given the prevailing conditions of the road. Any person that causes an accident while speeding could potentially face civil liability for their actions. Victims of car accidents tend to suffer serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Organ damage

Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is important that medical records and evidence are properly preserved after any accident. A personal injury attorney can examine the unique facts of your case and let you know what your legal options are.
