Liability for Injuries Caused by Consumer Products
Companies that create consumer products have a legal obligation to ensure that those products are reasonably safe. They must be tested in all the ways that they will likely be used and even misused. When a product has defects that result in an injury, this could form the basis of a product liability claim. There are many different ways that a product could be defective.
- Design Defects: A product may have inherent defects that are present before it is manufactured.
- Manufacturing Defects: A defect during the manufacturing process could cause a product to become unreasonably dangerous.
- Marketing Defects: when a product lacks adequate instructions or fails to warn consumers about latent dangers, this may point to a marketing defect.
The vast majority of accidents involving consumer products are preventable. In many cases, they involve companies that take safety shortcuts. This could include using subpar materials to construct a product. A big part of the problem is that many dangerous items will be imported from countries with less rigorous safety standards.
Steps to Take After Being Injured by Consumer Products
Many people are injured or killed every year in accidents involving fires that were started by consumer products. According to the Consumer Product Safety Commission, “Heating and cooling equipment fires constituted the second largest share of total residential fires. The estimated annual average of 37,600 fires for 2019 to 2021 was 10.7 percent of the annual average estimate of total residential fires during the same period.” Certain steps should be taken after any person is injured in a fire caused by a consumer product.
- Victims should seek medical treatment as early as possible.
- The product that caused the injury should be stored in a secure location.
- It should be determined if the product involved was on a recall list.
- Victims should seek the guidance of an experienced product liability attorney.
It can be hard to know where to begin after being injured by a consumer product. Many victims are left with serious bird injuries that require extensive surgeries. To make matters worse, companies will virtually never accept responsibility if their products injure a consumer. This is why it is so important that these incidents are investigated by an outside party. Any person injured by a faulty consumer product may be able to seek some measure of accountability through a personal injury claim.
