Round 2 Issues Recall For Auto World Unassembled Deluxe Pit Kit Slot Cars Because The Toys Violate Federal Magnet Safety Standards

discharged from hospital too soon

CHICAGO, ILLINOIS (March 11, 2025) – Round 2 has issued a recall for its popular Auto World Unassembled Deluxe Pit Kit Slot Cars because they pose a serious risk of injury if magnetic parts are ingested.

The recall was issued on March 6, 2025. Roughly 55,000 units were sold prior to the recall.

According to the Consumer Product Safety Commission, the Auto World Unassembled Deluxe Pit Kit Slot Cars violate mandatory federal regulations related to magnets.

In particular, children can be seriously injured if they ingest the magnets. They can become lodged in a child’s digestive system and result in major perforations, infections, blood poisoning, and death.

No injuries have been reported at this time.

Liability for Injuries Caused by Toys with Magnetic Parts

Injuries involving toys with magnetic parts may seem like freak occurrences, but they’re actually quite common. According to Nationwide Children’s Hospital, “High-powered magnets started showing up in children’s toys in the early 2000s and in desk sets in 2009. These small, shiny magnets made from powerful rare earth metals have led to thousands of serious child injuries since they arrived on the market. They are so strong that if more than one is swallowed, they can attract to each other across tissue, cutting off blood supply to the bowel and causing obstructions, tissue necrosis, sepsis and even death.” There are a number of regulations related to magnets in children’s toys.

  • Magnets and children’s toys have specific size and strength limits that should not be exceeded.
  • Magnets in toys for small children must not have a flux index greater than 50kG(2)mm(2).
  • Toys that contain magnets must have adequate warning labels that list the dangers associated with ingestion.
  • Toys with magnets must pass a safety test to ensure that the magnets are not able to detach easily.

Companies that create children’s toys have a legal obligation to ensure that they are reasonably safe. They must take into consideration all of the ways that their toys could be used and even misused. Children swallowing small toy parts is a known hazard. Companies must therefore take reasonable measures to prevent this from happening. They must be particularly cautious to avoid magnets from being swallowed since they can result in serious injury or death. When a company creates a product with design defects or fails to warn about the non-obvious dangers of their products, this could form the basis of a stripped product liability claim. There are several elements that must be demonstrated in any prima facie case of product liability.

  • The defendant sold the product that the plaintiff was injured by.
  • The defendant was the commercial seller of the product at issue.
  • The plaintiff suffered an injury.
  • When the defendant sold the item in question, it was already defective.
  • The defect with the item in question was the actual  and proximate cause of the plaintiff’s injury.

It can be hard to know where to begin if your child is injured by a toy. Parents assume that the age-appropriate toys they buy for their children are safe. But in far too many situations, this was simply not the case. Part of the problem is that toy manufacturers may overlook safety and testing standards in order to reduce overhead costs and save more money. This is totally unacceptable. Profits should never be valued over the health and safety of children. The parent of any child injured by a magnetic part for a toy may have legal recourse through a bodily injury claim.
