Skip Hop Issues Recall for its Baby Sesame Street Elmo Silicone Teethers Because They Can Pose a Major Choking Hazard for Young Children

.
CHICAGO, ILLINOISĀ (September 3, 2026)Ā – Skip Hop has issued a recall for its series of Baby Sesame Street Elmo Silicone Teethers Because a child could inadvertently choke and die, after putting them in their mouth.
The recall was issued on September 3, 2026. Over 22,000 units were sold prior to the recall. This includes over 3,000 units sold in Canada.
The Consumer Product Safety Commission says that the black eyes on Elmo’s face can detach if the unit is frozen. This creates the real hazard that a child could potentially die after ingesting one of the eyes.
The manufacturer has received at least four reports of the eyes detaching from the teether. There have been no reports of injuries at this time.
Liability for Injuries Caused by Defective Childrenās ToysĀ
Manufacturers owe a duty of care to the public to produce products that are reasonably safe. In Illinois, a manufacturer may be strictly liable for a defendant injury if their product was unreasonably dangerous. A product may be considered unreasonably dangerous if it has a propensity to break into small parts. This is particularly consequential if the product is intended to be used by small children that are susceptible to choking hazards. Federal law prohibits any product intended for children under three from having small parts that create a choking hazard under 16 C.F.R. Part 1501. Courts will examine several issues when evaluating whether or not a children’s product was unreasonably dangerous.
- They will examine whether or not a manufacturer violated the small parts rule.
- They will take into consideration whether or not the toy is likely to break into small parts.
- They will also consider whether or not different design choices could’ve been made to make the product safer.
- They will consider the packaging and labels attached to the product.
When a manufacturer fails to create a safe product, they could be held legally responsible for any resulting injuries. One case that comes to mind is Calles v. Scripto-Tokai Corp.*, 224 Ill. 2d 247Ā (Illinois Supreme Court 2007). That case involved a three-year-old who accidentally used a lighter that caused a house fire and the subsequent death of another child. Attorneys for the plaintiff argued that the product involved was defective due to its absence of a child resistance safety feature.
What to Do After any Accident Involving Defective Childrenās Product
Choking remains one of the leading causes of preventable injury and death for young children. Many of these injuries involve toys. According to Nationwide Childrenās, āresearchers in the Center for Injury Research and Policy at Nationwide Childrenās Hospital have found that an estimated 3,278,073 children were treated in United States emergency departments from 1990 through 2011 for a toy-related injury. In 2011, a child was treated every 3 minutes for such an injury.ā Parents should take several actions after their child has been injured by a toy.
- They should seek medical attention for their child as quick as possible. Many of the injuries associated with an accident are not going to be immediately obvious.
- The toy or product that caused the injury should be stored in a secure location so it’s not likely to cause more harm.
- It should be determined if the product involved was on any type of recall list.
- Parents should seek the guidance of an experienced product liability attorney. They may be able to pursue damages through a product liability claim.
There is a tremendous peace of mind that can come with having an experienced attorney handle your legal claim. They can deal with all court filings and negotiations with insurance providers. There is absolutely no upfront cost associated with hiring a product liability attorney. Instead, they get paid entirely on a contingency fee basis. They are paid entirely by the opposing party’s insurance provider if they’re able to successfully win your case.
