Blue Wave Above-Ground Pools 48 Inches Recall Over Drowning Hazard

CHICAGO, ILLINOIS (December 26, 2025) – Blue Wave Above-Ground Pools that are 48 inches or taller have been recalled because they pose a drowning hazard for children.

The recall was issued on December 18, 2025. Roughly 13,400 units had been sold prior to the recall.

According to the Consumer Product Safety Commission, the compression strap that surrounds the outer body of the pool can act as a foothold for young children.

This creates the possibility that a child could step on the strap and gain access to the pool. No injuries have been reported at this time.

The devices were originally manufactured in China and sold at numerous retail stores, including Home Depot and Lowe’s. They were also sold online at Walmart and Amazon.

Liability for Accidents Involving Pools

Drowning remains a leading cause of preventable injury and death for young children in the United States. According to the Centers for Disease Control, “More children ages 1–4 die from drowning than any other cause of death. For children ages 5–14, drowning is the second leading cause of unintentional injury death after motor vehicle crashes.” Companies that create above-ground pools should take several measures to ensure that their product does not pose an unnecessary drowning risk.

  • Built-In Access: Companies should not include built-in access to the pool by default. Instead, they should include removable fold-up ladders as standard equipment.
  • Footholds: Companies should ensure that above-ground pools do not have potential footholds or climbable features.
  • Clear Warnings: Companies must ensure that they warn consumers about the hazards posed by their product.

If a consumer product has design defects likely to cause serious injuries, this could create the basis of a product liability claim. A product liability claim can also be advanced on the legal grounds that a company failed to warn consumers about the dangers associated with their product. For example, an above-ground pool may lack adequate warnings that detail drowning risks to young children.

Steps to Take After Accidents Involving Consumer Products

Consumer products are responsible for many injuries and deaths involving young children each year. According to one study in Science Direct, “The consumer products used daily can present dangers, especially to children. Consumer products are associated with an annual 34.4 million injuries, 48,000 fatalities, and estimated $1 trillion in medical costs.” Parents should take several measures if their child has been injured by a consumer product.

  • All of the medical records related to the injury should be collected.
  • The item that caused the injury should be preserved. It may serve as an important piece of evidence in a civil trial.
  • It should be determined if there have been other injuries or deaths involving the affected product.
  • Parents should seek guidance from a skilled product liability attorney.

The lasting consequences of a near-drowning incident on a child can be severe. Many children are left with permanent neurological injuries. Some children may develop post-traumatic stress disorder from the experience. Sadly, the companies that make above-ground pools and their insurance providers will virtually never accept responsibility if a child is injured or killed in an accident with their product. This is why it is so critical that parents seek legal guidance.
