Liability For Electric Heaters Causing Fires
Fires caused by home heaters may seem like freak occurrences, but they are actually remarkably common. According to the U.S. Fire Administration, “Although trending downward since the early 1980s, heating fires remained the second leading cause of home fires in 2021. An estimated 32,200 home heating fires were reported to fire departments within the United States. These fires caused an estimated 190 deaths, 625 injuries and $442 million in property loss.” There are a number of common causes of heating fires.
- The leading cause of heating fires are space heaters located near flammable materials.
- The improper use of chimneys causes many heating fires every year.
- Malfunctioning furnaces can ignite fires if they are not properly maintained.
Companies that manufacture electric heaters have a legal obligation to make sure that they are reasonably safe. Among other things, they must ensure that their heaters are compliant with all safety standards set by the Consumer Product Safety Commission. When a product has design defects that lead to fires, this could form the basis of a product liability claim. There are numerous defects that a space heater could have that may contribute to a fire.
- A home heater may have faulty wiring. This may also include instances where wires are frayed due to improper installation.
- A home heater may lack emergency shut-off features when overheating takes place.
- A home heater may have blocked vents of filters due to poor design decisions.
It can be hard to know where to begin after any home fire caused by a faulty heater. Victims can suffer life-altering injuries. They may also face the loss of their home and earthly possessions. To make matters worse, companies that make faulty heaters will often do everything in their power to deny liability when their products injure someone. It is important that victims of these fires understand that they do have rights. They are able to seek some measure of justice through a civil claim.
