Darren Polk Killed in Springfield DUI Accident

Driver Arrested for Aggravated DUI Following Springfield Collision That Killed Darren Polk

.

SPRINGFIELD, ILLINOIS (October 3, 2026) – A 62-year-old man identified as Darren Polk tragically died in a Springfield car accident with a suspected intoxicated driver on 5th Street.

Sangamon County officials are saying that the collision occurred in the early morning hours of Sunday, September 27. An Audi was reportedly traveling south on 5th Street when that driver sped through a red light and hit a Toyota driven by Darren Polk.

Paramedics were called to the scene of the collision to help the injured victim. Despite life-saving measures, Darren Polk was later pronounced deceased at the hospital.

Authorities claim that they smelled alcohol on the breath of the Audi driver before arresting him. A full investigation into the crash remains ongoing.

Liability for Springfield DUI Car Accidents

Illinois law strictly prohibits operating any motor vehicle while under the influence of alcohol or drugs. Pursuant to 625 ILCS 5/11-501, “A person shall not drive or be in actual physical control of any vehicle within this State while: (1) the alcohol concentration in the person’s blood,       other bodily substance, or breath is 0.08 or more based on the definition of blood and breath units in Section 11-501.2.” There are many different ways that alcohol can dramatically impair a person’s ability to operate their vehicle safely.

  • Alcohol can make it difficult for drivers to operate within a single lane of traffic.
  • Alcohol can make it much more difficult for a driver to maintain a consistent speed.
  • Alcohol can dramatically reduce a person’s reaction time and thus increase the likelihood that they will not be able to stop to avoid a crash.
  • Alcohol can dramatically impair a person’s ability to make sound judgments related to their ability to drive safely.

There is a presumption of negligence on the part of any driver that goes past a red light or stop sign without yielding. Drivers that cause injury collisions while under the influence of alcohol or drugs could also face criminal liability for their actions in addition to civil responsibility. It is possible that responsibility for any collision could extend beyond one driver determined to be at fault. In particular, Illinois has dram shop laws that allow bars and other alcohol providers to be liable for collisions if they continue serving visibly intoxicated patrons.

What To Do After DUI Car Accidents

Driver intoxication remains one of the leading causes of preventable injury and death in the United States. According to the NHTSA, 11,904 people died in collisions with drivers that were under the influence of alcohol in 2024 alone. This accounts for roughly 30% of all motor vehicle fatalities that year. What many people do not understand is that there are a variety of substances besides alcohol that can impair their ability to operate a vehicle safely. Multiple actions should be taken after any Springfield DUI collision.

  • The police report created after the collision should be sought and carefully reviewed.
  • Any person who may have witnessed the crash should be interviewed early on.
  • The history of collisions at the location of the crash site should be investigated.
  • The family of any person who died in a DUI accident should consider their options with a team experienced in accident reconstruction and negligence claims.

It can be difficult to know what to do after any DUI collision. These crashes routinely leave victims with catastrophic injuries that impair their ability to work or even perform daily tasks. Of course, many victims do not survive their injuries. The family of any person who died in a DUI collision is protected by a number of laws. They’re able to seek some measure of accountability and transparency through a wrongful death claim.
