Elongdi Magnetic Building Sticks Sets Sold Exclusively on Amazon Recalled Over Federal Regulations for Toy Magnets
CHICAGO, ILLINOIS (January 15, 2025) – Elongdi Magnetic Building Sticks have been recalled because they can pose an ingestion hazard to small children.
The recall was issued December 19, 2024. Around 500 units were sold before the recall went into effect.
According to the recall notice by the Consumer Product Safety Commission, the recalled magnetic building sets violate federal regulations for magnetic toys.
In particular, if the toys are swallowed, they can attract each other and become lodged in a child’s digestive system. This can result in serious injuries, including infections, blockages in the intestines, blood poisoning, and death.
Prior to the recall, the Elongdi Magnetic Building Sticks were sold exclusively on Amazon.
Liability for Injuries Caused by Magnetic Toys
Toys with small magnetic parts can pose a serious safety hazard for children. According to the Consumer Product Safety Commission, “The U.S. Consumer Product Safety Commission (CPSC) is aware of at least 33 cases of children being injured from ingesting magnets. A 20 month-old died, and at least 19 other children from 10 months to 11 years old required surgery to remove ingested magnets.” There are several federal regulations related to magnetic toys.
- The magnet in any toy can only be so strong.
- Magnets must be securely contained to prevent detachment during both normal use and misuse.
- Warning labels should be added if toys contain accessible magnets.
Companies have a legal obligation to create products that are reasonably safe. They must be particularly careful when they create toys intended for children. Toy ingestion is a known hazard for small children. The problem with magnetic toys is that they can be lethal when ingested, even if a child does not choke on them. This is why it is so important that companies adhere to all safety regulations. Companies should take many measures to ensure that their toys are safe.
- Companies should familiarize themselves with all relevant federal, state, and international safety standards.
- Companies should use age-appropriate design principles.
- Companies should take into consideration all of the ways that their toys could be used or even misused.
- Companies should perform batch testing to ensure consistency.
When a company creates a toy with design defects that cause injury to a child, this could form the basis of a product liability claim. Liability may also arise if a company fails to provide consumers with adequate warning labels or instructions. It is important for consumers to understand that they do have legal rights if they are injured by a faulty product. They may be able to seek some measure of justice through a civil claim. A product liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
