Evajoy Above-Ground Pools Recalled Over Drowning Hazard

Recall Issued for Evajoy Above-Ground Pools 48 Inches and Taller Because They Pose a Drowning Hazard

CHICAGO, ILLINOIS (March 18, 2026) – Evajoy 48-inch and taller above-ground pools have been recalled because they can pose a serious drowning hazard for young children.

The recall was issued on February 26, 2026. Roughly 4000 units were sold prior to the recall.

According to the Consumer Product Safety Commission, the compression straps that surround the pool could serve as foot holds for a child. They may allow a child to enter the pool and potentially drown.

No injuries have been reported at this time. The Evajoy 48-inch and taller above-ground pools were previously sold on Amazon.

Liability for Pool Drowning Accidents

It has been known for a long time that drowning remains a major cause of preventable injury and death for young children. Companies that make above-ground pools have a legal obligation to ensure they are reasonably safe. They must comply with all safety standards and be rigorously tested. If a pool is defective, this could form the basis of a product liability claim. Several elements must be demonstrated in any prima facie case of product liability.

  • The defendant sold the product that was used by the plaintiff.
  • The defendant was the commercial seller of the product.
  • The plaintiff sustained an injury through their use of the product.
  • The product was defective when it was sold to the defendant.
  • The defect with the product was the actual and proximate cause of the plaintiff’s injury.

Product liability claims can be based on strict liability, negligence, or breach of warranty. Under strict liability claims, a defendant can be liable for a plaintiff’s injuries. If a plaintiff is able to demonstrate the product was defective. Liability will apply regardless of the defendant’s intent. In that sense, it is irrelevant if the defendant exercised a great deal of care to avoid harm.

Steps to Take After Pool Drowning Accidents

A number of children die in drowning accidents each year. According to the Centers for Disease Control, “More children ages 1-4 die from drowning than any other cause of death. Drowning is the second leading cause of unintentional injury death for children ages 5-14. Every year in the United States there are over 4,000 unintentional drowning deaths.” It is important that certain actions are taken after any pool drowning accident.

  • All medical records related to the incident should be collected.
  • It should be determined if the product is on a recall list.
  • Parents should seek the guidance of experienced product liability attorneys.

It can be difficult to know where to begin if your child has been harmed in any type of drowning accident. Parents often blame themselves for these incidents. But the truth of the matter is that many drowning accidents involve defective pools. The parents of any child harmed in a drowning accident are able to seek some measure of accountability through a civil claim.
