Liability For Will County Semi-Truck Accidents

Thousands of people are killed or seriously injured every year in the United States. According to the IIHS, “A total of 4,764 people died in large truck crashes in 2022. Seventeen percent of these deaths were truck occupants, 66% were occupants of cars and other passenger vehicles, and 16% were pedestrians, bicyclists or motorcyclists.” There are a number of reasons why semi-trucks can be particularly dangerous.

  • Semi-trucks can weigh over 80,000 lbs and even low-impact collisions can be dangerous.
  • Semi-trucks can take the length of two football fields to come to a complete stop.
  • Semi-trucks have large blind spots that may obscure the presence of smaller vehicles.

Truck drivers are required to get a commercial license and must do everything in their power to avoid collisions. According to Illinois Vehicle Code 625 ILCS 5/11-601, no person shall operate their vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. When a semi-truck driver fails to slow down to avoid a collision, this could form the basis of a negligence claim.

If a semi-truck driver fails to slow down for an emergency vehicle in Illinois, they could be cited for violating Scott’s Law. Scott’s Law is named in honor of Scott Gillen who worked for the Chicago Fire Department. He died after being hit by a drunk driver while responding to a car accident. There is simply no excuse for a driver to collide with a vehicle in their own lane of travel. Victims of truck accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Many of the injuries associated with truck accidents may not be immediately obvious. It is common for accident victims to have internal injuries. This is why it is so important for accident victims to seek medical treatment as early as possible. Any person who is injured due to the negligence of a truck driver may be able to seek some measure of justice through a civil claim. This is why it is so important to seek legal advice as early as possible after any collision.
