Liability for Libertyville Dump Truck Accidents
All drivers in Illinois have a legal obligation to exercise due care to avoid colliding with other vehicles in the roadway. They must maintain a safe speed at all times. According to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” There are many ways that a driver may have failed to avoid a collision.
- A driver may have traveled at an unsafe speed given the prevailing road conditions. In particular, driving the speed limit could be unsafe during periods of inclement weather.
- A driver may have failed to use their horn to alert other drivers of their presence.
- A driver may have taken a turn too sharply and lost control of their vehicle.
If a driver failed to slow down to avoid losing control of their vehicle, this could form the basis of a negligence claim. When a worker is injured in a car accident, they may also have recourse through a workers’ compensation system. Workers’ compensation operates through a no-fault insurance scheme. There is no need for an injured worker to demonstrate that one party or another acted negligently for them to receive benefits.
Steps to Take After Libertyville Dump Truck Accidents
Car accidents remain a major cause of injury and death for workers. According to the National Safety Council, “Injuries resulting from roadway incidents involving motorized land vehicles is the leading cause of work-related deaths. In 2023, 1,252 workers died and in 2021-2022, 68,560 DART cases including 54,830 DAFW cases were reported.” Certain actions should be taken after any dump truck accident.
- Surveillance footage that may have captured the accident should be sought.
- Victims should seek medical treatment as early as possible.
- All of the medical records related to the accident should be preserved.
- Any person injured in a dump truck accident should seek the legal guidance of an experienced truck accident attorney.
It can be difficult to know where to begin after any truck accident. Many victims are left with life-altering injuries and may need to take extensive periods of time away from work. Victims of truck accidents are protected by a number of laws. They are able to seek some measure of justice through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
