Liability For DuPage County School Bus Accidents

Buses are typically very safe for their passengers. Most of the people who are injured are in passenger vehicles. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” There are a number of measures that bus companies can take to prevent collisions.

  • Buses should be regularly inspected and well-maintained.
  • Bus drivers should be well trained.
  • Bus drivers should be well rested before beginning their shift.

Buses are considered common carriers and their drivers are held to a high standard in terms of safety. All bus drivers must exercise due care and reduce their speed to avoid hitting vehicles ahead of them. There is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane. Victims of school bus accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Any person that is injured in a school bus accident may be able to seek some measure of justice through a civil claim. A civil claim can help cover many of the expenses that come with a serious injury. Sadly, though, school districts will often fight hard to deny liability for any collision. This is why it is so important that all evidence is properly preserved after any collision.
