Liability For Crest Hill School Bus Accidents

School bus accidents may seem like freak occurrences, but they are unfortunately quite common. According to the National Safety Council, “School bus-related crashes killed 54 people nationwide in 2020, down by over 50% compared to 2019 according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” There are a number of factors that make school buses particularly dangerous for smaller vehicles.

  • School buses have large blind spots.
  • School buses weigh much more than passenger vehicles
  • School buses have a large turning radius.

School buses are considered “common carriers” under the Common Carrier Liability Act (740 ILCS 25/). Their drivers must use an abundance of caution to avoid accidents. Many collisions are due to speeding. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-601, no person shall operate a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the road. If a truck or bus driver fails to slow down to avoid a collision, this could form the basis of a negligence claim. Victims of bus accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

It can be hard to know where to begin after any collision. Many accident victims suffer serious and life-changing injuries. To make matters worse, truck and bus companies will often fight hard to deny liability for any collision. It is important for accident victims to know that they do have rights. They have the ability to recover damages through a civil claim if that is what they choose. It is extremely important that evidence is properly preserved after any collision.
