Joseph Lilly Injured in Salem Motorcycle Accident

Joseph Lilly, 41, of Centralia, Injured in Car Accident While Riding Motorcycle on West Main at the Hotze Road Intersection

.

SALEM, MASSACHUSETTS (September 5, 2026) – A 41-year-old man identified as Joseph Lilly was injured in a Salem car accident near the intersection of West Main and Hotze Road.

Salem police officials are saying that the incident occurred around 6:30 PM on Friday night. Joseph Lilly was stopped at a red light when his motorcycle was rear-ended by a 73-year-old woman.

The force of the impact pushed his motorcycle into the intersection before it became wedged under the left portion of the other vehicle. Paramedics were called to the scene of the collision to help the victim.

Joseph Lilly was transported to Salem Township Hospital to receive treatment. A full investigation into the circumstances leading up to the crash remains ongoing at this time.

Liability for Salem Motorcycle Collisions

Illinois law requires drivers to maintain a safe speed and following distance with the vehicles ahead of them under 625 ILCS 5/11-710. The exact distance that any driver will need to maintain depends heavily on the traffic conditions encountered that day. When a driver fails to exercise reasonable care and collides with another vehicle, this could form the basis of a negligence claim. Courts will take into consideration numerous factors when evaluating liability for any traffic accident.

  • Distractions: They will examine whether or not the vehicle that rear-ended a motorcycle may have potentially been distracted.
  • Visibility: They will take into consideration the visibility conditions at the time of the collision.
  • Surveillance: They will review any surveillance footage that may have captured the collision if it is available.
  • Intoxication: They will take into consideration any evidence that indicates a driver may have been intoxicated at the time of a crash.

There is a presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane of traffic. There are, however, some exceptions to consider. Consider, for example, Casey v. Pohlman, 198 Ill. App. 3d 503 (Illinois Appellate Court, Fifth District, 1990). A pickup truck that was attempting to make a left turn was involved in a collision with a semi-truck that was attempting to pass it. The Illinois Appellate Court held that a rear-end collision does not automatically establish that the rear driver is negligent when the circumstances surrounding the collision are disputed.

Steps to Take After Salem Motorcycle Collisions

Motorcycles lack the protection of enclosed vehicles and are more susceptible to being seriously injured or killed in the event of a collision. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 16.2% of all traffic fatalities and 3.6% of all injuries in 2024.” There are a number of actions that should be taken after any person is injured in an Illinois motorcycle accident.

  • Victims should seek medical treatment as early as possible. Many of the injuries associated with the crash are not going to be immediately obvious.
  • Victims should get the insurance information of the other driver involved and the contact information of any witnesses.
  • Victims should get a copy of the police report created after the crash. This can be a useful tool for many different purposes.
  • Victims should carefully consider their legal options with a team experienced in motorcycle accident claims.

It can be difficult to know what to do after any motorcycle collision. These accidents routinely leave victims with long-term damage that can impact their ability to work or even perform daily tasks. The full extent of the trauma caused may not be understood for some time. Gathering numerous forms of evidence related to the crash can help establish who was liable. It can also provide victims the opportunity to pursue damages through a civil action. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
