GARFIELD RIDGE, CHICAGOĀ (September 22, 2026)Ā – A 50-year-old man identified as Juan Luna has tragically died in a Garfield Ridge car accident along South Archer Avenue.

Cook County officials are saying that the collision occurred around 5:15 AM on September 14. Juan Luna was riding an e-bike when he was hit by a blue pickup truck that collided with a sedan turning at the intersection.

Paramedics were called to the scene of the collision to help the victim. Juan Luna was transported to Advocate Christ Medical Center in Oak Lawn with critical injuries.

Sadly, he succumbed to his injuries at the hospital the following day on September 15. The pickup truck driver involved in the crash did not remain at the scene of the collision.

That driver is currently being sought by the police. There have also been a number of other fatal collisions at that same intersection.

This includes one crash that killed an 84-year-old woman.

Liability for Illinois Bicycle Accidents

Drivers in Illinois have a legal responsibility to exercise due care to avoid pedestrians and cyclists. Under 625 ILCS 5/11-1003.1, ā€œNotwithstanding other provisions of this Code or the provisions of any local ordinance, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian, or any person operating a bicycle or other device propelled by human power and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused, incapacitated or intoxicated person.ā€ Courts will take into consideration numerous factors when evaluating liability for any bicycle collision.

  • History: They will review any previous history of crashes or complaints regarding the intersection.
  • Speed: They will consider whether the driver involved was traveling at a safe speed given the prevailing road conditions.
  • Visibility: They will consider the visibility conditions at the time of the crash. It matters whether or not an intersection’s sightlines are obstructed.
  • Impairment: They will go over evidence that a driver may have been intoxicated by alcohol or some substance at the time of a collision.

When a driver fails to slow down to avoid colliding with a cyclist, this could serve as evidence of negligence. Depending on the unique facts of any case, liability for a bicycle accident could extend to several parties beyond any specific driver found to be at fault. This includes a city that was responsible for the roadway where the collision took place. Consider, for example, Cole v. City of East Peoria, 201 Ill. App. 3d 756 (Ill. App. Ct. 1990). That case involved a bicyclist that was injured after their wheel became caught in a drainage grate. The plaintiffs argued that the city negligently allowed the unsafe drainage grate to remain in the roadway even though they knew the design was dangerous, and there was a history of similar collisions at that location.

Preventing Bicycle Collisions in Illinois

Bicycle collisions remain a major public safety issue across Illinois and the United States. According to one report by the NHTSA, there were 35 pedalcyclist fatalities across the state of Illinois in 2022 alone. Nine of these deaths occurred in the city of Chicago. Roadway design plays a substantial role in many of these collisions. Cities should take a number of actions to help prevent bicycle accidents.

  • Cities should review crash histories at streets and intersections with a history of collisions.
  • Cities should consider adding protected bicycle lanes that separate cyclists from traffic.
  • Cities should ensure that intersections are well illuminated so that drivers are able to see and avoid cyclists.
  • Cities should heavily enforce traffic infractions that are likely to lead to bicycle accidents.

Bicycle collisions are often highly complex events. The factors that contribute to any crash could take place many hours or even days beforehand. It is important that these incidents are thoroughly investigated. This is particularly true for any hit-and-run collision. Even a small fragment of the vehicle that fled the scene can be used to track it down later on. The family of any person who died due to the negligent actions of another driver is able to seek some measure of accountability through a wrongful death claim.
