Liability for Shirley Car Accidents

Thousands of pedestrians are killed or seriously injured each year in the United States. According to one study by the Illinois Department of Transportation, “Crashes involving pedestrians accounted for 1.4% of total crashes, 16.9% of fatal crashes and 6.2% of injury crashes. Crashes involving pedalcyclists accounted for less than 1.0% of total crashes, 3.1% of fatal crashes and 3.8% of injury crashes.” Several factors may contribute to a pedestrian collision.

  • Speeding: Roughly one-third of all fatal pedestrian collisions involve a driver who is speeding.
  • Intersections: Pedestrians are much more likely to be involved in collisions at traffic intersections.
  • Inclement Weather: Another major factor that contributes to pedestrian collisions is inclement weather. Poor weather conditions can reduce a driver’s visibility and make it more difficult for them to stop in the event of an emergency.

All drivers must use caution to avoid hitting any vehicle in the roadway. This is true even if a pedestrian is in the middle of the road. Pursuant to 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian or cyclist on the roadway. They must use their horn when necessary to alert pedestrians of their presence, and be particularly cautious around any person who appears to be confused or incapacitated.

If a pedestrian accident involved a vehicle used for commercial purposes, liability for the collision could extend beyond the driver involved. Pickup trucks and vans are routinely used for commercial purposes. Even many passenger vehicles are used for transportation services like Uber. As a general rule, employers are vicariously liable for the wrongful actions of their workers–insofar as those workers act within the course and scope of their job duties. Collecting evidence is essential after any pedestrian collision.

  • Surveillance footage that may have captured the accident should be sought.
  • Photos of the accident site should be taken.
  • The speed of the driver involved should be determined.

The physical evidence left behind after a collision can help paint a clear picture of what happened. This is true regardless of what any particular driver may claim. In so many situations, pedestrian accidents are the result of drivers who are simply not paying adequate attention to the road ahead of them. Victims of pedestrian accidents have rights under the law. In particular, the family of any pedestrian who died in the collision may be able to seek some measure of accountability through a civil claim.
