The La Bella of Danville Nursing Home Cited For Numerous Violations By The Illinois Department of Health and Human Services
DANVILLE, ILLINOIS (January 31, 2025) – The La Bella of Danville nursing home has been cited for several violations by the Illinois Department of Health and Human Services.
According to the Illinois Department of Health and Human Services, the nursing home had a fly infestation. There were also nutrition issues reported with the food.
The facility used to be called Arcadia of Danville. One document revealed that a patient was treated for a wound in his right leg.
Five days later, a nurse discovered that his dressing had maggots in it. Six days after those initial maggots were discovered, another seven adult maggots were found in his wrap.
Liability for Illinois Nursing Home Neglect
Abuse and neglect within a nursing home setting is unfortunately very common. According to Cureus, “Many studies estimate that about 10% of all people over the age of 65 experience some form of abuse. These rates are often higher in long-term care facilities such as nursing homes, despite government regulations aimed toward addressing this issue.” Nursing homes should take a number of measures in order to prevent abuse and neglect.
- Nursing homes should conduct a thorough background check on all employees.
- Nursing homes should provide all of their staff comprehensive training on what constitutes abuse.
- Nursing homes should educate all employees on proper patient care procedures.
- Nursing homes must maintain adequate staff-to-resident ratios.
- Nursing homes should do their best to foster an environment of transparency and accountability.
Nursing home abuse and neglect are strictly prohibited under both state and federal law in Illinois. The Nursing Home Reform Act (1987) establishes minimum standards of care that nursing homes are required to meet. Among other things, all residents of a nursing home are entitled to live free from abuse, neglect, and exploitation. Nursing homes are required to be particularly careful about preventing pressure ulcers, which can be common in a care setting. When a nursing home fails to adequately care for the physical and mental needs of patients, this could form the basis of a negligence claim. Several steps should be taken after any suspected instance of misconduct in a nursing home setting.
- The resident’s immediate safety should be ensured. This may require that the resident be taken to a different nursing home or stay with family.
- The resident should receive all of the medical care they need. Again, this may require admitting them to a hospital separate from the nursing home.
- All of the instances of abuse or neglect should be well documented. This may include keeping records, taking photos, and collecting other forms of evidence.
- The misconduct should be reported to state and federal health agencies.
- Family members of the victim should seek the guidance of an experienced nursing home abuse attorney.
It can be hard to know where to begin if your loved one has been mistreated in a nursing home setting. Nursing home residents are particularly vulnerable to abuse and mistreatment. It is for that reason extra steps should be taken to ensure their health and safety. Nursing home residents and their families should understand that they do have rights. They are able to seek some measure of justice and accountability for any instance of abuse through a civil claim. A nursing home abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
