Liability for Walmart Truck Accidents

The vast majority of goods that are bought and sold every year in the United States spend at least some amount of time in a commercial truck. Trucks are essential for the economy, but they can pose major safety hazards for those and smaller vehicles. According to the FMCSA, “In 2021, 5,904 large trucks and buses were involved in fatal crashes, a 18-percent increase from 2020. From 2020 to 2021, large truck and bus fatalities per 100 million vehicle miles traveled by all motor vehicles increased from 0.176 to 0.191, 7 percent below the 21st-century peak of 0.205 in 2000.” Truck drivers should take several measures to avoid collisions.

  • Blind Spots: Truck drivers should be aware that their vehicles have large blind spots and check those blind spots before making turns.
  • Speed: Truck drivers should operate their vehicle at a safe speed at all times. They must take into consideration the prevailing traffic and hazards existing on the roadway.
  • Rest: Truck drivers must take periodic breaks as required by law in order to avoid becoming potentially dangerously fatigued.

Truck drivers must use caution to avoid colliding with smaller vehicles. Many truck accidents are due to truck drivers that make dangerous lane changes. Pursuant to 625 ILCS 5/11-709, the driver of any vehicle must operate their vehicle entirely within a single lane of traffic and may only move to a different lane if such a movement can be made with reasonable safety. If a truck driver makes a dangerous turn or lane change into the path of another vehicle, this could form the basis of a negligence claim.

Truck accidents are often highly preventable. They tend to involve situations where truck drivers are pushed to complete deliveries on unrealistic time schedules. If a truck driver was working as an employee at the time of an accident, their employer could be held at fault. However, companies routinely hire truck drivers as “independent contractors” to avoid direct liability for collisions. Victims of semi-truck accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

Truck accidents are often some of the most difficult events that people will go through in their lives. The victims may need to take extensive periods of time away from work. They could also be left with high medical bills. To make matters worse, truck drivers and their insurance providers will go out of their way to deny any liability for a collision. This is why it is so important for victims of truck accidents to seek the guidance of an experienced attorney. An attorney can take measures to help accident victims get the medical and financial support that they are entitled to.
