Liability for Farm Tractor Accidents

Companies that manufacture farm equipment have a legal obligation to ensure that that equipment is reasonably safe. They must take into consideration all of the ways that their product could be used and even misused. In particular, there are a number of ways that a piece of farm equipment may have been defective.

  • Design Defects: a piece of farm equipment may have had no protective guards around the moving parts. It may also have lacked emergency shut-off mechanisms.
  • Stability Control: A piece of farm equipment may have lacked stability features or rollover protection structures (ROPS).
  • Manufacturing Defects: A piece of farm equipment may have faulty welds or weak structural joints. It is also possible that defective wiring could lead to a short circuit or fire.

Many product liability claims are pursued on the basis of strict liability. Under strict liability, a defendant is liable for an accident involving their product if the plaintiff is able to demonstrate that the product is defective. In that instance, it doesn’t matter what the defendant’s intent was. They will still be liable, even if the manufacturer or supplier exercises great care.

Steps to Take After a Farm Tractor Accident

Far too many people are seriously injured or killed in farm tractor accidents each year. According to Agricultural Safety & Health, “Our work found 41 deaths in 2017, and 34 in 2018. Tractors were the source of the majority of non-highway fatalities, and machinery is often the agent involved in entanglement, amputation injury, crushing, and other forms of non-fatal injury.” It is important that certain steps are taken after any farm tractor accident.

  • Medical Evaluation: Victims should seek a thorough medical evaluation as soon as possible. Many of the injuries associated with farm tractor accidents may not be outwardly obvious.
  • Police Investigation: The police should be called to the scene so that they can begin an investigation. This can help ensure that key pieces of evidence are properly preserved.
  • Legal Support: Victims of farm tractor accidents should seek guidance from an experienced personal injury attorney. An attorney can examine all of the unique facts of your case and let you know what your legal options are.

Any person injured in a farm tractor accident may be able to seek some measure of accountability and justice through a personal injury claim. These accidents can often be highly complex, especially if a defect with a tractor caused what happened. The companies that manufactured farm equipment will often fight hard to deny any responsibility for what happened. This is why it is so important that these accidents are properly investigated by an outside party.
