Liability for Rockford Car Accidents
Pedestrians are uniquely vulnerable to the hazards posed by motor vehicles. Larger cars and trucks can be particularly dangerous. According to National Public Radio, “Vehicles with higher front ends and blunt profiles are 45% more likely to cause fatalities in crashes with pedestrians than smaller cars and trucks, according to new research published Tuesday by the Insurance Institute for Highway Safety.” There are a number of factors that can increase the likelihood of a pedestrian collision.
- Drivers are much more likely to hit pedestrians when they’re making turns.
- Drivers are much more likely to hit pedestrians during the early morning and late evening hours when visibility is reduced.
- Drivers are more likely to hit pedestrians if they are speeding.
- Drivers are more likely to hit pedestrians if they are intoxicated by alcohol.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim.
Depending on the facts of any case, there could be numerous sources of liability for any pedestrian collision. Pickup trucks are often used for commercial purposes. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. In general, employers are vicariously liable for the wrongful actions of their employees working within the course of their job duties. Victims of pedestrian accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Spinal cord injuries
- Amputations
Even if a pedestrian is able to completely heal physically after a collision, they often suffer very traumatic psychological injuries. This includes PTSD, anxiety, and depression. Symptoms of PTSD can include recurring nightmares about the traumatic event. Any person injured in a Rockford pedestrian accident may be able to seek some measure of accountability through a personal injury claim. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
