Liability For Fox Lake Pedestrian Accidents

Thousands of people are killed or seriously injured in pedestrian collisions every year. According to the IIHS, “Pedestrian motor vehicle crash deaths have increased 59 percent since reaching their low point in 2009 and account for 17 percent of crash fatalities. The rates of pedestrian deaths in motor vehicle crashes per 100,000 people are highest for people ages 20-69.” There are a number of steps that drivers should take to avoid hitting pedestrians.

  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should check their blind spots before making turns.
  • Drivers should abstain from alcohol and drugs.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-601), all drivers must not operate their vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down and hits a pedestrian, this could form the basis of a negligence claim.

Liability for a pedestrian accident may extend beyond any driver. If a pickup truck driver was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any car accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.

Dealing with the loss of a loved one can be one of the most difficult things that most people will ever have to go through. However, it is important for accident victims to remember that they do have rights. They have the right to pursue a civil claim for damages if that is what they choose. Sadly, though, it is common for drivers to deny all liability for any collision. This is why it is so important that all evidence is properly preserved after a crash.
