Liability for McHenry County Car Accidents
Car accidents remain a leading cause of preventable injury and death in the United States. Many of these incidents involve drivers who fall asleep or are fatigued. According to the National Highway Transportation Safety Association, “NHTSA estimates that in 2017, 91,000 police-reported crashes involved drowsy drivers. These crashes led to an estimated 50,000 people injured and nearly 800 deaths. But there is broad agreement across the traffic safety, sleep science, and public health communities that this is an underestimate of the impact of drowsy driving.” There are many different factors that could contribute to drowsy driving.
- Medications: There are many different medications that could cause drowsiness as a side effect.
- Long Hours: Drivers routinely become fatigued due to working long hours.
- Inadequate Breaks: Drivers may become fatigued because they have not gotten the chance to take a break during their trips.
All drivers have a legal obligation to exercise due care to avoid collisions. This necessitates that they follow all traffic regulations. Pursuant to 625 ILCS 5/11-709, a vehicle shall be driven entirely within a single lane of traffic and not move from that lane unless such a movement can be undertaken with reasonable safety. There is a presumption of negligence on the part of any driver who leaves the roadway and collides with a fixed object.
If the driver of a vehicle was working at the time of a collision, their employer could potentially be held at fault. As a general principle, employers within the state of Illinois are considered vicariously liable for the wrongful actions of their workers–insofar as they are operating within the course and scope of their job duties. It is very common for vans to be used for commercial purposes. Certain steps should be taken after any car accident.
- Accident victims should seek a thorough medical evaluation, even if they feel ok after a collision. Many injuries are not immediately apparent.
- Photos of the accident site should be taken.
- A police report of the incident should be collected.
- Victims should seek the skilled guidance of an experienced personal injury attorney.
It can be hard to know where to begin after any collision. These incidents can be enormously disruptive to a person’s life. People are often left with high medical bills and may need to take extensive periods of time away from work. Any person injured in a car accident within the state of Illinois may be able to seek some measure of justice through a personal injury claim. Damages can help cover medical bills and lost wages.
