Liability for Witt Tractor Accidents
When a worker is injured in Illinois, they will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme that allows injured workers to recover damages. There is no need for an injured worker to demonstrate that one party was liable. Injured workers are also able to recover damages through a third-party liability claim. There could be numerous sources of third-party liability for any tractor accident.
- Contractors: If a tractor accident was caused by the negligence of a contractor separate from a worker’s employer, that entity could face some liability for what happened.
- Tractor Company: The company that manufactured a tractor could be liable for an accident if it was caused by some type of defect with the product.
- Drivers: Many tractors are hit by vehicles. The drivers of these vehicles could be liable for an accident if they failed to exercise the care necessary to prevent the collision.
It is important that evidence is properly preserved after any tractor accident. Evidence can help reveal what parties could be liable. Unfortunately, insurance companies will often fight hard to deny responsibility for any accident where a person is injured by a tractor. Their goal is to save as much money as possible by paying victims as little as possible.
Preventing Illinois Tractor Accidents
Tractors are involved in many serious accidents each year. According to the Occupational Safety and Health Administration (OSHA), “Tractor overturns are the leading cause of fatalities in the agriculture industry, resulting in approximately 130 deaths per year. The majority of tractor overturn incidents take place when these farm vehicles turn on their side or tip over backward.” Employers should take several actions to prevent rollover accidents.
- Tractors with over 20 horsepower should have roll-over protective structures (ROPS).
- Every tractor with a ROPS must be equipped with a seat belt.
- Employees should be trained on how to safely use tractors.
The vast majority of tractor accidents are completely preventable. In many instances, the tractors involved in these accidents do not have functional ROPS. Victims of tractor accidents should understand that they do have legal rights. They are able to seek some measure of accountability through a personal injury claim. A tractor accident attorney can examine the unique facts of your case and let you know what your legal options are.
