Liability for Monmouth Industrial Accidents

Employers in Illinois have a legal obligation to maintain work sites in a reasonably safe condition that promotes the safety and well-being of their workers. Pursuant to 29 U.S.C. § 654(a)(1), “each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” Courts will take into consideration numerous factors when evaluating liability for any workplace accident in Illinois.

  • Machine Guards: They will examine whether or not machinery and equipment had the appropriate safeguards to prevent entanglement.
  • Storage: They will look into the storage of any hazardous energy or materials that could cause workers to be injured.
  • Contractors: They will evaluate whether or not a contractor or other company had safety responsibilities for a dangerous condition at the property.
  • Prior Incidents: They will review all of the maintenance records and any potential history of prior incidents at the facility.

Workplace accidents in Illinois are typically governed by the Illinois Workers’ Compensation Act, 820 ILCS 305/5. Injured workers and their surviving family members will typically have recourse through the system, regardless of who may be considered at fault for an accident. In addition to workers’ compensation claims, an injured worker or their surviving family member may be able to pursue damages through a third-party liability claim. See, for example, Munoz v. Bulley & Andrews, LLC, 2021 IL 127067 (Ill. 2022). A third-party liability claim may be possible if an entity separate from the worker’s employer acted negligently and contributed to an accident.

Safety and Accountability After Illinois Workplace Accidents

Animal processing facilities present a number of major industrial hazards for workers. According to one study by the U.S. Bureau of Labor Statistics, the animal slaughtering and processing industry recorded 3.2 non-fatal workplace injuries for every 100 full-time workers. Part of the issue is that workers are often forced to use or navigate dangerous equipment in these facilities. Meat processing plants should take a number of actions to help keep their workers safe.

  • Employers should install and maintain effective machine guards.
  • Employers should utilize strict lockout/tagout procedures before cleaning or repairing any piece of equipment.
  • Employers should provide their workers with the appropriate protective equipment for these specific tasks they will be handling.
  • Employers should maintain all floors and walkways in a safe condition to prevent slips and falls.

Workplace accidents are typically highly preventable. They tend to be the consequence of one or more major safety failures. Part of the problem is that employers may begin to prioritize efficiency in a way that subverts critical OSHA safety standards. It is important that victims of workplace accidents understand that they do have rights. In particular, the family of any person killed in a workplace accident may be able to pursue some measure of accountability through a civil action.
