Liability In Chicago Pedestrian Accidents

Motor vehicle deaths have edged up in Chicago over the past several years. According to Streets Blog Chicago, “Tragically, total on-street Chicago traffic deaths spiked from 96 in 2019, to 139 last year, a 45 percent increase, according to preliminary Chicago Police Department data released today by the Chicago Department of Transportation.” The vast majority of pedestrian collisions are totally preventable. There are many factors that could contribute to a pedestrian collision.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1002, the driver of any motor vehicle shall yield the right of way to any pedestrian that is crossing in a lawfully marked crosswalk. Even if a pedestrian is not in a marked crosswalk, drivers still must do everything in their power to avoid hitting them. If a driver fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian collisions tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

It is crucial after any accident that there is a thorough investigation. Many pedestrian accidents are captured with surveillance cameras. Eye witnesses should be interviewed. Even in the absence of eye witnesses or video footage, the physical evidence left behind at a crash site can paint a picture of what happened.
