Liability In Evanston Pedestrian Accidents

According to the Illinois Department of Transportation, “In 2020, there were 246,752 crashes involving motor vehicles in Illinois. Injury crashes accounted for 21.1% of these crashes (52,090), while fatal crashes (1,088) accounted for less than 1.0% of these crashes. Crashes involving pedestrians accounted for 1.3% of total crashes, 15.8% of fatal crashes and 5.8% of injury crashes.” The vast majority of pedestrian accidents are preventable and involve some amount of human error. There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • Drivers should check their blind spots before making turns.
  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should continuously scan the road ahead of them for potential hazards.

Every driver has a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to 625 ILCS 5/11-1002, the driver of any vehicle must yield the right-of-way to any pedestrian that is crossing in a marked crosswalk. If a driver fails to reduce their speed in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Many accident victims may not realize the full extent of their injuries for several weeks or months after a collision. Indeed, a large number of accident victims report experiencing PTSD several months or years after the experience. It is important that all medical records are properly preserved after any collision. A person’s injuries often paint a picture of what happened regardless of what any particular driver may claim.
