Liability for Chicago Semi-Truck Accidents
Trucks can be particularly dangerous for pedestrians. According to National Public Radio, “Vehicles with higher front ends and blunt profiles are 45% more likely to cause fatalities in crashes with pedestrians than smaller cars and trucks, according to new research published Tuesday by the Insurance Institute for Highway Safety.” There are a number of reasons that semi-trucks can be particularly dangerous.
- A fully loaded semi-truck can weigh as much as 80,000 lbs., thereby making even low-impact collisions deadly.
- Semi-trucks have enormous blind spots that can easily obscure the presence of pedestrians in the roadway.
- Semi-trucks have a high ground clearance, which can lead to pedestrians being pulled under the hood.
Truck drivers have a legal obligation to exercise a great deal of care in order to avoid collisions. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. If a truck driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps are taken after any truck accident.
- Eyewitnesses should be interviewed.
- Surveillance footage related to the crash should be sought.
- Medical records related to injuries should be preserved.
- An experienced truck accident attorney should be contacted.
Truck accidents can be extremely disruptive to a person’s life. Victims may need to take extensive periods of time away from work. They could also be burdened with high medical bills. In many cases, a serious injury could leave an accident victim with a permanent disability. Any person injured due to the negligent actions of a truck driver may have legal recourse through a civil claim. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
