EAST PEORIA, ILLINOIS (April 27, 2026) – A 42-year-old pedestrian has tragically died in an East Peoria car accident not far from the Par-A-Dice Hotel and Casino on Route 116.

East Peoria officials are saying that the collision took place around 4:35 PM on Friday afternoon. A pedestrian was struck by a vehicle and seriously injured in the process.

Liability for East Peoria Car Accidents

Drivers in Illinois must use caution to avoid hitting any pedestrian in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. There are many ways that a driver may have acted negligently prior to a pedestrian collision.

  • A driver may have been traveling too fast for the prevailing conditions.
  • A driver may have been distracted by their phone or other object.
  • A driver may fail to check their blind spots before initiating a turn.
  • A driver may not use their horn to alert pedestrians of their presence.

When a driver fails to slow down to avoid colliding with a pedestrian in the roadway, this could be construed as negligence. Even if a pedestrian is in the middle of a road, this does not relieve a driver of their duty of care to avoid a crash. Illinois is one of several states that adjudicates claims on the basis of comparative negligence. Even if the victim of a collision was partially at fault, this will not bar their ability to pursue a civil claim.

Steps to Take After East Peoria Car Accidents

Thousands of pedestrians are seriously injured or killed every year in preventable car accidents. According to the Centers for Disease Control, “Over 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2022. That’s about one death every 64 minutes. There were also an estimated 140,000 emergency department visits of pedestrians treated for non-fatal crash-related injuries in 2022.” Multiple steps should be taken after any Illinois car accident.

  • The police report for the collation should be examined.
  • Medical records for related injuries should be sought.
  • The actions of the driver leading up to the crash should be scrutinized.
  • The family of the deceased victim should seek the guidance of an experienced personal injury attorney.

Pedestrian accidents tend to be highly preventable. They often involve drivers that are speeding or are committing other traffic infractions. Any person who is injured in a collision may have legal recourse through a civil action. This right extends to the surviving family members of any person who dies. They are able to seek some measure of accountability through a wrongful death claim.
