Liability In Fairmont City Pedestrian Accidents

Pedestrians are uniquely vulnerable in car accidents. They are more likely to be overlooked due to their small profile. They also lack the protection of enclosed vehicles. According to The National Center for Health Statistics (NCHS), “in 2019 most pedestrian traffic deaths occurred in urban settings (82%), on the open road (73%) versus intersections (26%), and during dark lighting conditions (80%).”  There are a number of different factors that could potentially contribute to a pedestrian accident including:

  • Speeding
  • Distracted driving
  • Inclement weather
  • Dangerous turns

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. The vast majority of pedestrian accidents can be avoided when drivers slow down in areas with pedestrian traffic. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-601),  no person may drive a vehicle at a speed that would be unreasonable or unsafe given the prevailing conditions of the road. It is important that evidence is properly preserved after any collision.

  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • Medical records should be examined.
  • The vehicles involved should be thoroughly inspected.

The family of any victim that died in a pedestrian accident may be able to seek aid through a wrongful death claim. Damages can help cover lost wages, medical bills and funeral expenses. Potential beneficiaries in a civil claim will typically include a victim’s next of kin such as their spouse or children. An Illinois wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
