Liability for Chicago Pedestrian Accidents
Drivers in Illinois must use caution to avoid colliding with any pedestrian in the roadway. According to 625 ILCS 5/11-1002, “When traffic control signals are not in place or not in operation the driver of a vehicle shall stop and yield the right-of-way to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger.” Multiple factors could contribute to any pedestrian accident.
- Pedestrian accidents are more likely to occur in the early morning hours when visibility is reduced.
- Pedestrian accidents are more likely at intersections.
- Pedestrian accidents may involve drivers that are distracted by looking at their cell phones.
When a driver fails to slow down to avoid colliding with any pedestrian, this could serve as evidence of negligence. Drivers must slow down and use caution to avoid hitting pedestrians, even if they are outside of lawfully marked crosswalks. Depending on the specific facts of any case, liability for a pedestrian accident could extend beyond any driver determined to be at fault. For example, a city could be liable for a pedestrian accident caused by a dangerous condition on a public roadway.
Steps to Take After Illinois Pedestrian Accidents
Pedestrian accidents are a major cause of serious injury and death across Illinois and the United States. According to the Governors Highway Safety Association, “Drivers struck and killed 7,148 people walking in the United States in 2024, down 4.3% from the year before and the second annual decline, but nearly 20% higher than the 2016 level.” It is important that certain actions be taken after any pedestrian collision.
- The police should be called to the scene so that they can investigate.
- Eyewitnesses should be interviewed as early as possible.
- Photos of the accident site should be taken.
- The family of any person who died should contact a team experienced in accident reconstruction and tort claims.
It can be difficult to know where to begin after any pedestrian accidents. Victims are often left with serious injuries. They require extensive medical treatments. To make matters worse, insurance companies will almost never accept responsibility when their driver is involved in a crash. It is important for victims to understand that they do have legal options. They’re able to seek some measure of accountability through a civil action.
