Liability for Park Ridge Car Accidents

Drivers must exercise caution to avoid colliding with any pedestrian in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” Drivers should take several actions to avoid any pedestrians.

  • Drivers should continuously scan the road ahead of them for potential hazards.
  • Drivers should use their horn when necessary to alert pedestrians of their presence.
  • Drivers should check their blind spots before making turns at intersections.

When a driver fails to slow down and collides with a pedestrian, this may be construed as negligence. Even if a pedestrian was in the middle of a roadway. This does not relieve a driver of their responsibility to use caution and take evasive action. Depending on the facts of any case, liability for pedestrian crash could extend beyond a driver deemed to be at fault. For example, the company that owned a vehicle could be liable if a driver was working for a business at the time of a collision.

Steps to Take After Park Ridge Car Accidents

Far too many pedestrians are killed or seriously injured every year in preventable car accidents. According to the United States Department of Transportation, “Each year, unfortunately, pedestrian and bicyclist fatalities comprise about 20 percent of all traffic fatalities with approximately 7,000 pedestrian deaths and 1000 bicyclist deaths. Another 60,000 pedestrians and 42,000 bicyclists are injured in roadway crashes annually.” It is important that certain actions are taken after any pedestrian collision.

  • Medical Records: All of the medical records related to any injuries should be collected and preserved.
  • Eyewitnesses: All of the eyewitnesses that may have seen an accident should be interviewed as early as possible, while their memories are still fresh.
  • Surveillance Footage: Any surveillance footage that may have captured the accident should be reviewed.

It can be difficult to know where to begin after any pedestrian accident. Victims are often left with serious injuries and may need to take extensive periods of time away from work. Any person injured in a pedestrian collision may be able to get some measure of justice and accountability through a civil action. This right extends to the family of any person who died.
