Manufacturer Recalls Over 2.3 Million Ricky Joy Sour Crush Candy Bottles After It Was Discovered They Could Pose a Choking Hazard

.
CHICAGO, ILLINOIS (September 23, 2026)Ā – The popular Ricky Joy Sour Crush Candy Bottles have been recalled because they can pose a major risk of serious injury or death from choking.
The recall was issued on September 10, 2026. An estimated 2.3 million bottles of the candy were sold before the recall was announced.
The CPSC recall notice indicates that the rolling ball on the recalled candy bottles may inadvertently detach. A child could subsequently ingest this ball and choke on it.
No injuries have been reported at this time. The candy was initially manufactured in Colombia.
Liability for Injuries Caused by Defective CandyĀ
Companies that create food products have an obligation to ensure that those products are not likely to cause major harm during foreseeable use. This necessitates that companies take certain precautions to prevent their candy and other products from becoming a major choking hazard. A company could potentially be liable if a child or other person is injured by their products if those products lack sufficient warnings about potential dangers. Moreover, under Section 15 of the Consumer Product Safety Act, manufacturers, distributors, and retailers must notify the CPSC if they become aware that a product is unreasonably dangerous. There are a number of steps that companies should take to prevent their products from becoming a choking hazard.
- Companies should ensure that any product designed for small children lacks small parts that could easily detach or break off.
- Companies should rigorously test their products and all the ways that they are likely to be used or even misused.
- Companies should do everything in their power to track consumer complaints and take action when they have become aware of a danger.
- Companies must comply with all federal safety standards related to products for children.
When a company fails to warn the public about a major hazard associated with their product, this could form the basis of a strict product liability claim. Under strict liability, a defendant can be held liable for an accident if the plaintiff is able to prove that the product is defective. Liability will apply regardless of the defendant’s intent. In other words, it does not matter if the defendant exercised a great deal of care to avoid causing harm. Courts will evaluate several tests to determine whether or not a defendant is liable for a plaintiff’s injuries. These include the risk utility test and the consumer expectation test.
How an Attorney Can Help After an Injury Involving a Consumer Product
Many children are seriously injured or killed every year after ingesting potential choking hazards. According to one study by the Centers for Disease Control, there were an estimated 17,537 children under the age of 14 that were treated in US emergency rooms for choking-related episodes in 2001 alone. Gum and candy were involved in roughly 20% of all of those incidents. There are many different ways that an attorney can help after any accident involving a defective consumer product.
- An attorney will investigate whether or not the product in question was defective.
- An attorney can help preserve all of the evidence related to the product.
- An attorney can investigate recalls, consumer complaints, and other incidents that may have indicated that the product was defective.
- An attorney can work with engineers and medical professionals to help determine how a product’s defect may have contributed to an injury.
There is a great amount of peace that can come with having an attorney handle everything related to your product liability claim. They can do all of the hard work while you focus on recovering. There are also no upfront costs associated with hiring a product liability attorney. They work entirely on a contingency fee basis. What this means is that they only get paid by the opposing party’s insurance provider if they are able to successfully resolve your claim.
Getting Legal Help After Being Injured by a Defective Product
Corporations have known for quite some time that choking remains one of the leading causes of serious injury and death for young children. Unfortunately, those same companies have often failed to implement sensible safety precautions that could’ve prevented many of these accidents. This is why it is so important that any accident where a child is harmed by a product is properly investigated by an outside party.
